1. Who we are
The ASCEND service is operated by ascentscan ("we", "us"). By using ASCEND you agree to these Terms.
2. Acceptance
By accessing or continuing to use ASCEND you agree to be bound by these Terms. If you do not agree, do not use the service.
3. The service
ASCEND provides AI-powered facial analysis, scores, recommendations, and progress tracking. Outputs are generated by AI models and may be inaccurate. They are not medical, cosmetic, psychological, or professional advice and should not be relied on as such.
4. Acceptable use
- No unlawful use, fraud, spam, or harassment.
- No infringement of intellectual property or privacy rights.
- No interference with security (malware, probing, scraping, reverse engineering).
- You may only upload photos of yourself, or of others with their express consent.
- No upload of illegal content, content depicting minors, hate speech, or deepfake material.
5. Your content & AI outputs
You retain ownership of the photos and content you upload. You grant us a limited license to host and process that content solely to provide the service. You are responsible for your prompts, uploads, and how you use AI outputs, including verifying their accuracy and ensuring you have rights to the input content. We may remove, restrict, or refuse outputs and may suspend accounts for repeated infringement.
6. Accounts
You must provide accurate information, keep credentials confidential, and are responsible for activity under your account. You must be of legal age in your jurisdiction.
7. Intellectual property
We retain all rights in the service, its software, models, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with your plan.
8. Payments & subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.
9. Suspension & termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination, your access ends; data may be exported or deleted in line with our Privacy Notice.
10. Warranties & liability
The service is provided "as is" without warranties of any kind to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free performance. To the maximum extent permitted, our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages, except where excluded by law (e.g. fraud, death, or personal injury).
11. Indemnity
You agree to indemnify us against claims arising from your content, unlawful use, or breach of these Terms.
12. Changes
We may update these Terms from time to time. Material changes will be communicated through the service.
13. Governing law
These Terms are governed by the laws of the seller's jurisdiction, with exclusive jurisdiction of its competent courts, unless mandatory consumer law provides otherwise.
